Terms & conditions of carriage

Please read these standard terms carefully. They govern all courier, freight, transport, and logistics services provided by Eways Logistics Pty Ltd across Australia.

Effective date & last updated: September 2026

Important Notice: Under these Conditions of Carriage, the Customer acknowledges that Eways Logistics Pty Ltd is not a common carrier and reserves the right to refuse carriage of any goods. Freight is carried at the Customer’s own risk unless optional Transit Insurance is selected.

1. Definitions & Interpretation

In these Conditions of Carriage:

  • Carrier means Eways Logistics Pty Ltd (ABN 45 612 890 123), its subsidiaries, employees, agents, and sub-contractors.
  • Customer or Consignor means the party requesting the carriage of goods, whether an individual, commercial entity, or agent acting on their behalf.
  • Consignment means all goods, parcels, satchels, pallets, or items accepted by the Carrier from the Customer under a single booking or consignment reference.
  • Charges means the amounts payable for carriage, fuel surcharges, manual handling, waiting time, failed pickup, re-delivery, and other ancillary logistics fees.
  • Transit Insurance means optional cover purchased during booking to protect against specified accidental physical loss or damage during transit.

2. Carrier Status: Not a Common Carrier

Eways Logistics is not a common carrier and accepts no liability as such. The Carrier reserves the right to refuse the carriage or storage of any goods or class of goods for any reason whatsoever at its sole discretion.

3. Quotations, Pricing & Weight Audits

All initial instant quotes generated online are valid for a period of 7 calendar days from the date of quotation. Prices are calculated using the greater of actual dead weight (kg) or volumetric cubic weight:

Cubic Weight (kg) = Length (m) × Width (m) × Height (m) × 333 kg/m³

Auditing & Weight Discrepancies: All consignments pass through automated dimensioners and scales at carrier hub depots. If the actual or cubic weight exceeds the declaration provided by the Customer, the Carrier reserves the right to automatically adjust the invoice and charge the difference plus an administration re-weigh fee ($15.00 + GST).

Ancillary Surcharges: Additional fees apply for residential delivery, tailgate/tail-lift requirements, remote regional deliveries, futile pickup attempts ($25.00 + GST), or driver waiting time in excess of 15 minutes.

4. Customer Packaging & Warranties

The Customer expressly warrants that:

  • The goods have been prepared, packed, marked, and labelled adequately to withstand the ordinary risks of road and air freight handling.
  • Cartons are made of sturdy corrugated cardboard, internal cushioning is sufficient, and seams are securely sealed with heavy-duty packing tape.
  • Pallets are securely strapped, shrink-wrapped without overhang, and stable for forklift and truck transit.
  • All address details, recipient contact phone numbers, and delivery instructions are complete, accurate, and legible.

5. Dangerous & Prohibited Goods

Unless declared in writing and specifically approved by the Carrier prior to dispatch, the Customer warrants that the Consignment contains no Dangerous Goods as defined in the Australian Dangerous Goods Code (ADG Code), IATA regulations, or Civil Aviation Safety Authority (CASA) rules.

Strictly prohibited items include explosives, firearms, flammable gases, radioactive substances, toxic chemicals, cash, bullion, perishable biological specimens, and illegal narcotics. The Customer fully indemnifies the Carrier against all fines, damages, and third-party claims arising from undeclared dangerous goods.

6. Pickup, Delivery & Authority to Leave (ATL)

Delivery is deemed complete when the consignment is delivered to the specified destination address or handed to a person representing the recipient.

Authority to Leave (ATL): Where the Customer or receiver has granted Authority to Leave (ATL), the driver will leave the goods in a safe location if available. In doing so, the Carrier’s responsibility ceases immediately upon drop-off, and neither the Carrier nor its insurers are liable for any subsequent loss, theft, weather damage, or tampering.

7. Subcontracting & Carrier Network

The Carrier is entitled to subcontract on any terms the whole or any part of the carriage. Every exemption, limitation, condition, and liberty herein contained applies equally to all subcontractors, agents, and servants.

8. Limitation of Liability & Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.

To the maximum extent permitted by law, the Carrier’s liability for loss of or damage to goods where optional Transit Insurance has NOT been taken is strictly excluded. Under no circumstances will the Carrier be liable for indirect, incidental, or consequential losses, including loss of profits, loss of markets, or reputational damage.

9. Transit Insurance & Claims

Where the Customer elects to purchase Transit Insurance at the time of booking confirmation, claims for loss or damage are subject to the terms of the insurance policy, the declared value, and the standard policy excess ($100 per claim).

Notification Timelines: Damage claims must be reported in writing with supporting photographic evidence within 48 hours of delivery. Claims for non-delivery must be lodged within 7 business days of the scheduled delivery date.

10. Payment Terms, Charges & Carrier’s Lien

Guest customers must pay in full at the time of booking via authorized payment gateways. Approved Business Account holders are subject to agreed credit terms (typically 7 or 14 days from statement date).

The Carrier has a general and particular lien on all goods in its possession for all charges and debts due from the Customer. If charges remain unpaid after 28 days written notice, the Carrier may sell the goods to recover outstanding amounts.
